How to Make a Complaint Appeal

What Harassment means:

Any unwelcome sexual advance, request for sexual favour or other verbal or written communication or physical conduct of a sexual nature or sexually demeaning attitudes, causing interference with work performance or creating an intimidating, hostile or offensive work environment, or the attempt to punish the complainant for refusal to comply to such a request or request or is made a condition for employment.

Presentation of complaints:

Any person (man/woman) can submit complaints to Federal Ombudsman. A complaint written in English or Urdu may be presented at the Registrar Office of Federal Ombudsman Secretariat. A complaint can be submitted personally or through his/her representative or may be sent by post, courier service, fax, e-mail or any other means of communications.

Contents of the complaint:

  • A comprehensive statement of all facts relating to an incident of harassment at the work place with all necessary details i.e. exact dates, time, place and occurrence of the incident.
  • All documents, evidence or other material in whatever form it may be, such as audio, video or documentary or in any other form.
  • List of witnesses alongwith copies of their CNIC, Address and phone numbers.
  • Any other material, detail, evidence or person which will be relied or having any relation with the incident.
  • The complainant shall submit affidavit that information contained in his/her complaint is true and correct to the best of his/her knowledge and belief.
  • Power of attorney in proper form, if required.
  • Memo or addresses of complainant and respondent.
  • The complaint shall be duly signed by the complainant or if he/she cannot sign shall affix thumb impression.

Where the Registrar find that a complaint requires further information, verification of facts, all documents, He may ask the complainant for provision of such information, verification of facts or documents.

How to Register an Apeal

Any party aggrieved by the decision of the competent authority of the Inquiry Committee constituted under the Act of Protection Against Harassment Of Women At Work Place Act, 2010 on whom minor or major penalty is imposed may within 30 days of written communication of decision prefer an appeal to Federal Ombudsman established under Section 7.

Contents of Appeal:

  • Any person aggrieved by a decision of the competent authority may prefer an appeal under Section 6 of the Act, in his/her own name.
  • Appeal shall contain all materials, statements and arguments relied upon by the appellant.
  • Appeal shall be complete in all respects and shall not contain any matter which is derogatory and accusatory or disrespectful or in improper language.
  • Every appeal shall be submitted directly to the Registrar Office of the Appellant Authority i.e. Federal Ombudsman.
  • The contents of the appeal shall be verified by the aggrieved party to be true to his/her knowledge and belief and sign or affix with thumb impression.

The appellant authority may on consideration of appeal and any other relevant material, confirm, set aside, vary or modify the decision within 30 days in respect of which such appeal is made. It shall communicate the decision both the parties and the employer.
